Staging, Organizing & Packing Services Agreement + Staging Accessory Rental Agreement

This Agreement is entered into between The Staging Genius ("Company" or "Lessor") and the undersigned Client ("Lessee"). By signing this Agreement, the Client agrees to the following terms and conditions.


1. RECITALS

A. The Company owns the furniture, décor, and accessories ("Accessories").


B. The Company agrees to lease these Accessories to the Client for staging at a designated property ("Subject Property").


2. RENTAL TERMS & USE OF STAGED ITEMS

  • The Company grants the Client the right to display but not use the Accessories.

  • Staged items cannot be used for personal purposes (e.g., sleeping on beds, sitting on furniture).

  • Items must remain at the Subject Property unless written approval is provided.

  • Listing Proof Requirement: Client must provide proof that the home is listed for sale within 14 days of furniture delivery. Failure to do so results in a $100 per day fee until proof is provided.


3. RENTAL FEES & PAYMENT TERMS

  • The Client agrees to pay the full rental fee listed on the invoice.

  • Payment is due before installation unless agreed otherwise in writing.

  • Late payments incur a $100 daily fee and may result in immediate removal of staged items.

  • If staging extends past the agreed rental period, additional fees will apply.

  • After the home closes, staging items must be scheduled for pickup before or on closing day. A $100 per day fee applies if items remain beyond the closing date.


4. CHANGES, CANCELLATIONS & TERMINATION

  • Adding Items: The Company and Client may agree to add more items under this Agreement.

  • Early Termination by Company: The Company may remove items with 5 days’ written notice or immediately if:

    • The Client defaults on payments.

    • The Client damages or moves staged items without permission.

5. PROPERTY ACCESS & CLIENT RESPONSIBILITIES

  • The Client grants the Company full access to the Subject Property for installation, maintenance, and removal.

  • The Client must ensure the home is clean, free of construction debris, and ready for staging at least 1 day before the Staging Date.

  • The Client must provide entry access (e.g., lockbox code, key, security code).

  • The Client confirms permission for the Company to hang artwork, mirrors, and other items.

  • The Company is not responsible for filling holes left after staging removal.


6. DAMAGE, LOSS, & SECURITY RESPONSIBILITY

  • The Client is fully responsible for the care and security of staging items.

  • If an item is damaged, lost, or stolen, the Client agrees to pay:

    • Full replacement cost for lost or destroyed items.

    • Repair and loss-of-use fees for damaged items.

  • Security Responsibility: The property must have functioning fire and theft protection.


7. LIABILITY, INDEMNIFICATION & HOLD HARMLESS

  • The Client agrees to indemnify and hold harmless The Staging Genius from any claims, damages, or liabilities related to the staging.

  • The Company is not responsible for:

    • Pre-existing property damage.

    • Injuries occurring in the staged home.

    • Theft or vandalism of staged items.


8. ADDITIONAL FEES & FINANCE CHARGES

  • Rescheduling Fees:

    • 48+ hours notice: No charge.

    • Less than 48 hours notice: $200 rescheduling fee.

    • Company arrives but cannot stage due to construction or cleaning issues: $200 rescheduling fee.

  • Finance Charges:

    • $50 per day applies to unpaid invoices.

    • A $50 service charge applies for returned checks.

    • Client pays all legal fees if collection actions are required.

9. PHOTOGRAPHY & MARKETING CONSENT

  • The Company may photograph the staged property for marketing purposes.

  • The Client grants permission for these images to be used for advertising.


10. THIRD-PARTY SERVICE PROVIDERS

  • The Company may work with third parties for delivery, moving, and installation.

  • The Client acknowledges that the Company is not liable for third-party service failures.


11. CLIENT UNDERSTANDING & DISCLAIMER

  • The Company is not a contractor, inspector, or engineer and does not assess a property’s structural integrity.

  • The Company does not provide real estate transfer disclosures and does not guarantee a home’s sale or price increase.


12. FORCE MAJEURE (Uncontrollable Events)

  • The Company is not responsible for delays due to uncontrollable events, including: extreme weather, power outages, pandemics, acts of war or terrorism.


13. ENTIRE AGREEMENT & BINDING TERMS

  • This Agreement represents the entire agreement between both parties.

  • No oral modifications are valid. Changes must be in writing and signed by both parties.

  • The Client may not transfer this Agreement to another party.


14. ORGANIZING & PACKING

  • The Company offers:

    • Organizing services to declutter and prepare homes for sale.

    • Packing services for storage or moving.

    • Consulting services for staging improvements. 

  • Liability:

    • The Company is not responsible for pre-existing damage to personal belongings.

    • The Client is responsible for informing the Company of fragile or high-value items.

    • The Client agrees to hold the Company harmless for any claims related to organizing and packing services.

15. CLIENT ACKNOWLEDGEMENT & SIGNATURE

By signing below, the Client acknowledges that they:

  • Have read and understand this Agreement in full.

  • Agree to all terms and conditions listed.

  • Understand the financial and legal obligations outlined.
