Vacant and Supplemental Staging Furniture Rental + Services Agreement

IMPORTANT: All Homeowners must sign this Agreement. If the staging is being paid for by the Homeowner’s Real Estate Agent(s), the Agent(s) must also sign this Agreement.

This Agreement ("Agreement") is entered into by and between The Staging Genius™ ("Company") and the undersigned:


  • Homeowner(s) ("Client-Homeowner"), who is the owner of the Subject Property to be staged; and

  • Paying Party ("Client-Paying Party"), who may be the Homeowner(s) or their Real Estate Agent(s), and is financially responsible for the services outlined herein.


By signing this Agreement, both parties agree to the following terms and conditions:


RECITALS

A. The Company owns the furniture, décor, and accessories ("Accessories").

B. The Company agrees to lease these Accessories for staging at a designated property ("Subject Property").


SERVICES

The Company provides the following services:

  • Vacant Staging

  • Partial/Occupied Staging

  • Pre-Listing Cleaning


LIABILITY

  • The Company is not responsible for pre-existing damage to personal belongings.

  • The Client-Homeowner must inform the Company of any fragile or high-value items.


Deposit & Booking:

  • Client-Paying Party agrees to pay a non-refundable $500 deposit to secure staging date. 

  • Client-Homeowner and Client-Paying Party agree to sign the agreement Agreement to secure staging date. 

  • Client-Paying Party agrees to remit full rental fee as invoiced.


Payment Terms:

  • The original invoice fee covers the first three (3) months of staging, starting on the agreed staging date.

  • Starting month four (4), 25% of the total original invoice is due monthly and paid for by the Client-Paying Party. 

  • All sales are final, and we do not offer returns or refunds. However, if you are unsatisfied with your purchase, we can provide replacement furniture for an additional fee. This would be paid for by the Client-Paying Party. 


Late Payment & Fees:

  • Unless Client has elected and Company has approved the Pay-at-Closing Option in writing, full payment is due on the staging day.

  • Any amount not paid when due will incur a $100 per day late fee until paid in full. Company may suspend services and/or remove staged items if payment is not received when due. Client remains responsible for all unpaid balances, late fees, and any collection costs permitted by law.


Second Floor and Above Fee:

An additional $100 fee applies to any property on the second floor or above, including properties with elevator access.


Pay-at-Closing Option:

  • If approved by Company in writing at least 5 calendar days before staging day, Client may elect the Pay-at-Closing Option.

  • Client must pay a $500 non-refundable deposit to reserve the staging date, which will be applied toward the total invoice.

  • A $300 Pay-at-Closing fee will be added to the invoice.

  • The remaining balance is due in full on the earliest of: (a) closing, (b) the property being taken off the market, (c) listing expiration or cancellation, (d) Client’s request for staging removal, or (e) Company’s removal of the staging as permitted under this Agreement.

  • This option applies only to the initial 3-month staging term. If staged items remain in the property beyond that term, extended rental terms will apply (see below).


Extended Rental After Initial 3 Months:

  • If staged items remain in the property after the initial 3-month term, monthly rental charges equal to 25% of the original invoice will begin on the first day of month 4, billed monthly in advance, whether or not the property has closed. Failure to pay any extension invoice when due may result in late fees and/or removal of staged items.


Rescheduling:

  • Free with 5+ business days’ notice.

  • $500 fee with less than 5 business days’ notice. Paid for by Paying Party. 


Early Termination by Company:

  • Company may remove items with 5 days' written notice, or immediately if : a) Client-Payment Party Fails to make payments, or b) Client-Homeowner Moves or damages items without consent.


RENTAL TERMS & USE OF STAGED ITEMS

Vacant Staging:

  • Accessories and furnishings are for display purposes only and may not be used (e.g., no sitting, sleeping, or dining).

  • Accessories and furnishings may NOT be moved, removed, or altered without prior written permission from the Company. If any items are used, moved, or altered without permission, the Company reserves the right to immediately remove all staged items without providing a refund.

Partial & Occupied Staging:

  • The Client-Homeowner is responsible for damage, misuse, or dirt.

  • Damaged items will be invoiced to the Client-Homeowner within 5 business days; payment due within 5 business days of invoice.


PROPERTY ACCESS & CLIENT RESPONSIBILITIES

  • Client-Homeowner must grant full access for install, maintenance, and removal.

  • Property must be clean, clear, and ready at least 1 day before staging.

  • The Client-Homeowner or Client-Paying Party must provide entry instructions (lockbox code, key, etc.).

  • Client-Homeowner grants permission for Company to hang wall art and mirrors using nails.

  • The Company is not responsible for patching or repairing holes after removal.


DAMAGE, LOSS, & SECURITY RESPONSIBILITY

  • Client-Homeowner is responsible for all items during the rental period.

  • Client-Homeowner is financially liable for:

    • Full replacement cost of lost/stolen items.

    • Repairs and loss-of-use fees for damaged items.


LIABILITY, INDEMNIFICATION & HOLD HARMLESS

  • Client-Homeowner agrees to indemnify and hold harmless The Staging Genius™ for:

    • Pre-existing property damage

    • Injuries in the staged property

    • Theft or vandalism of Accessories


PHOTOGRAPHY & MARKETING CONSENT

  • The Company may photograph the staged property.

  • Client-Homeowner consents to use of these images (including professional photos) for marketing purposes.


CLIENT UNDERSTANDING & DISCLAIMER

  • The Company is not a contractor, inspector, or engineer.

  • The Company does not guarantee sale price, market time, or offer structural evaluations.

  • The Company does not provide disclosure documentation.


ENTIRE AGREEMENT & BINDING TERMS

  • This document represents the full agreement.

  • No verbal changes are valid.

  • Any changes must be in writing and signed by all parties.

  • This Agreement is non-transferable.


CLIENT ACKNOWLEDGEMENT & SIGNATURE

By signing below, both the Client-Homeowner and Client-Paying Party acknowledge that they:

  • Have read and understand this Agreement in full.

  • Acknowledge that the Client-Homeowner is responsible for damage, loss, or theft of Accessories due to:

    • Personal use

    • Guests

    • Showings

    • Property issues

    • Natural disasters

  • Acknowledge that The Real Estate Agent(s) are NOT liable for damage, loss, or theft of Accessories.

  • Acknowledge and consent to the use of pre-owned furnishings, which may show minor signs of wear, as part of the staging design.

  • Client must schedule the pickup of staging items at least 7 days in advance to ensure availability and proper coordination.
